1. basic principles
These conditions of participation govern the legal relationship between the guest (you) and the City of Frankfurt am Main - represented by the City Marketing Department and Tourismus+Congress GmbH - (us/we) in connection with the Rooftop Day. With resolution ยง4994, the City Council approved submission E218_2024 and instructed the municipal authorities to introduce a Rooftop Day as a recurring event in Frankfurt am Main. The City Marketing Department was entrusted with the lead responsibility for realising the event together with the city's Tourismus+Congress GmbH. Rooftop Day Frankfurt will take place for the first time on 23 August 2025 in Frankfurt am Main (entire city area, with a focus on the city centre).
The aim is to highlight Frankfurt's unique architecture. The large, concentrated number of high-rise buildings and accessible rooftops makes Frankfurt unique in Germany.
On the first Frankfurt Rooftop Day (Rooftop Day), we offer Frankfurt institutions, associations and professional event locations the opportunity to make their rooftops (roof terraces, upper floors or balconies) accessible to the public (guests) as hosts and to offer an event (music, culinary delights, readings, yoga or similar) on their own initiative. The locations do not have to be run professionally, but can also be professional event locations. The hosts are free to organise their own events. The City of Frankfurt operates the website www.rooftopday.de, where you can find the hosts' programme and plan your personal Rooftop Day.
2. no claim to realisation of the Rooftop Day
In principle, the Rooftop Day also takes place in bad weather. However, there is no legal entitlement to its realisation. If we cancel the Rooftop Day for reasons such as bad weather, official intervention or safety concerns, we will announce this immediately on our website.
3. intellectual property rights
We or our licensors retain all copyrights, trademark rights, industrial property rights and other rights to the website and its content as well as to photos and videos created or commissioned by us. Modification, duplication, reproduction, publication or disclosure to third parties without our written consent is not permitted.
4. disclaimer of warranty and liability
The individual events only establish a legal relationship between you and the hosts. The City of Frankfurt am Main is not involved in the implementation and therefore not in the legal relationship, but merely provides the website and the programme with the event information. The City of Frankfurt is not liable for claims of any kind between you and the host or other third parties in connection with the individual events organised by the hosts. Any such claims on your part are to be asserted exclusively against the respective host.
The City of Frankfurt am Main accepts no liability for the uninterrupted availability of the website or for the accuracy, completeness, appropriateness and topicality of the content provided there. These are checked with the greatest possible care, but may contain errors. References and links to third-party websites lead to external content which the City of Frankfurt am Main does not adopt as its own and for whose content it is not liable.
Otherwise, the City of Frankfurt am Main shall be liable without limitation for damages resulting from injury to life, limb, health, guarantees and/or cardinal obligations as well as for damages caused by intent or gross negligence on the part of its legal representatives, employees or vicarious agents. In the event of a breach of cardinal obligations, liability for simple negligence is limited to the typical contractual damage.

By participating in the Rooftop Day, you give your consent for us or photographers commissioned by us to take photos and videos of you and for us to use these for marketing purposes (e.g. for aftermovies, advertising for future Rooftop Days or other events). If you do not agree to this, please inform the photographers directly at the respective event.
6. final provisions
Should any provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. In this case, the parties shall replace the invalid provision with a valid provision that comes closest to the economic purpose of the invalid provision. The same applies to loopholes.
The law of the Federal Republic of Germany shall apply. Subject to mandatory statutory provisions, the exclusive place of jurisdiction for all disputes arising from or in connection with the Rooftop Day is Frankfurt, Frankfurt am Main.
